In , the National Association of Insurance Commissioners (NAIC) approved an extensive update to its long-standing Suitability in Annuity Transactions Model Regulation. The result is a revised, consumer-focused set of standards and practices that elevate a consumer’s best interest as the core component of any and all annuity recommendations and sales.

The biggest change the model brings about is an upgrade in practice standards and requirements from ensuring the suitability of an annuity recommendation or sale to ensuring that an annuity recommendation or sale meets the consumer’s best interest. While this requirement to the client's best interest is more encompassing than the prior suitability standard, but is not a fiduciary standard.



The NAIC's revised Suitability in Annuity Transactions Model Regulation and new Best Interest standard is being adopted on a state-by-state basis, and states are not required to adopt the revision. However, if your state does not adopt the updated model regulation, this may lead to additional annuity training requirements.

The map to the right shows each state's adoption status of the updated model regulation (the “NAIC Model Regulation States”). State's that have been highlighted green on the map have officially adopted the revised Suitability in Annuity Transactions Model Regulation and Best Interest training standard, while the yellow states are considering adopting the new model regulation in the near future.

CFP ethics course update: the most up-to-date CFP CE courses

For more than three decades, the CERTIFIED FINANCIAL PLANNER certification has been the standard of excellence for financial professionals. As part of CFP® certification, all CFP® professionals commit to the high standards outlined in the Code of Ethics and Standards of Conduct. This, along with the steps CFP Board has taken to enforce the Code and Standards, distinguishes the CFP® certification from other credentials in the financial services industry.

WebCE is excited to announce another new version of our CFP® ethics CE course, Ethics CE: CFP Board's Revised Code and Standards. The CFP® ethics CE course has been periodically updated since the CFP Board’s revised Code of Ethics and Standards of Conduct became effective on October 1, 2019. They formally began enforcing the new Code and Standards on June 30, 2020.

Revised CFP® CE Ethics Course

The content of the updated CFP® ethics course, Ethics CE: CFP Board's Revised Code and Standards, is based on CFP Board’s revised Code of Ethics and Standards of Conduct—simplified as Code and Standards—which became effective on October 1, 2019. The content of the course was written by CFP Board and covers the revised Code and Standards to deliver the two hours of CE ethics study required for all CFP® professionals.

The ethics course consists of six modules, and each module addresses a key course learning objective. Included throughout the presentation are numerous case studies, exercises, and informative videos, all intended to emphasize or clarify core learning points. At the end of the course, students must complete a short final assessment with a passing score of 70% or better. Students have three chances to achieve a passing score. If a student doesn’t pass the course exam after three attempts, they must re-review the course content.

Changes to the Revised Code and Standards

The revised Code and Standards has a new structure and organization, which identifies and defines the duties of a CFP® professional. It also contains substantial changes from the previous Code, including:

  • The requirement to act as a fiduciary when providing financial advice to Clients, which is an expansion of the scope and reach of the duty from its prior application
  • Appropriate ways CFP® professionals should disclose and handle conflicts of interest, which have also been enhanced
  • The duty to report and cooperate with CFP Board to ensure that the high standards of ethics and competency set forth in the Code and Standards are met. This duty has been greatly expanded.
