Course Description
Insurance professionals and risk managers must be aware of exposures arising for employment law claims. Employment-related claims can be very costly, driven by the high attorney's fees involved in these claims.

There are a number of laws that impact employment law, but Title VII is the cornerstone. Title VII protects against discrimination, harassment, or retaliation based on certain protected categories. Title VII makes it illegal for an employer to fail or refuse to hire or discharge any individual, or otherwise to discriminate against any individual, with respect to compensation, terms, conditions, or privileges of employment because of an individual's race, color, religion, sex, or national origin. This course will review the Acts in detail focusing on discrimination based on sex, gender, religion, racial, and national origin, along with insurance implications for the various exposures.

Learning Objectives
Students who successfully complete this course will be able to:

  • identify the key areas covered by Title VII
  • distinguish between sexual, religious, national origin, and race harassment and discrimination
  • recognize the effects of the types of harassment and discrimination covered under Title VII
  • recognize the elements and impacts of the Americans with Disabilities Act (ADA)
  • recognize the elements and impacts of the Age Discrimination in Employment Act (ADEA)
  • recognize the elements and impacts of the Family and Medical Leave Act (FMLA)
  • identify what retaliation encompasses and the elements of a retaliation claim
  • identify the extent to which insurance coverage may be available
