Overview

On a daily basis, life and health producers deal with the formation and execution of legal contracts that take form and shape as insurance policies. Accordingly, producers should understand the legal concepts that are central to these contracts and to the business of transacting insurance. From an examination of insurance regulation to the basics of contract law, from the concepts of risk and insurable interest to consumer protections, this course discusses the general principles and doctrine of insurance law with which all producers should be familiar.

Learning Objectives

Upon conclusion of this course, students will be able to:

  • understand the basis of law and regulation that govern the business of insurance
  • explain the basic characteristics and components of an insurance contract
  • understand how both federal and state laws protect consumers today through regulation of insurance products and insurance company trade practices
  • define the agency relationship, who the involved parties are, and an insurer's potential defenses against liability
  • explain the tax consequences of an insurance policy's failure to meet the definition of life insurance and the transfer of a life policy for valuable consideration
  • explain the requirements and prohibitions the Patient Protection and Affordable Care Act (PPACA) places upon insurers
  • understand the problem of unauthorized entities in the insurance industry and the consequences of representing an unauthorized insurer
