Overview

Environmental liability exposures require special attention, because standard general liability and commercial auto policies severely restrict coverage for pollution incidents. At the same time, various laws and regulations require shippers and haulers to assume responsibility for injury, damage, and cleanup and remediation costs associated with a spill or other pollution incident, even in cases where a firm was only remotely related to the incident. The transportation of hazardous materials creates obvious exposures, but leakage or spills of seemingly innocuous cargo such as milk and ketchup have also been a source of pollution claims.
